The rules of using Saplet. Short where it can be, careful where it has to be.
These terms are between you and Saplet, a trade name of Alyssa Meek, a sole proprietorship based in Colorado ("Saplet", "we", "us"). By creating an account or using Saplet you accept them. If you are setting Saplet up for a household, you accept them on behalf of that household and you are responsible for the people in it.
You must be at least 18 to create an account. Children use Saplet through a profile created for them by the adult who owns the account. That adult is responsible for deciding whether Saplet is suitable for their child and for supervising their use of it.
Keep your password to yourself and tell us if you think someone else has it. You are responsible for what happens under your account and for the household members you add, including choosing sensible usernames and passwords for children. Do not use another person's real full name, address or contact details as a display name.
While Saplet is in beta it is a work in progress. Features may change or disappear, things will break, and we may need to reset data as the app is rebuilt. We will warn you before anything destructive if we possibly can, and you can export your data at any time. Please don't rely on Saplet as the only record of anything that matters.
Beta testers keep Saplet free for as long as the service exists. What that covers, and the one narrow exception, is set out in section 5.
Saplet is free while it is in beta. Pricing for new customers after the beta has not been set yet, and will be shown clearly before anyone is asked to pay anything.
If you were invited into the beta and accepted, you keep Saplet free for as long as the service exists. That includes:
The one exception is a genuinely new and separate feature added later, of a kind that was not part of the base app. If we ever build something like that, it may carry a small one-time charge, it will always be optional, and Saplet will keep working exactly as it did if you don't buy it. We will never take away or degrade something you already had in order to sell it back to you.
If you ever do pay us and you are unhappy with Saplet, email saplet.app@gmail.com within 30 days of that purchase and we will refund it. You do not have to explain why.
We will never quietly convert a one-time purchase into a subscription, and we will never charge you again without telling you first.
Don't use Saplet to harass, bully, threaten or demean anyone, including members of your own household. The nudge and teasing features exist to be playful about a game, never to be cruel about a person. Also don't: break the law with it, try to access another household's data, reverse engineer or resell the service, upload malware, or upload photographs of anyone who hasn't agreed to be photographed.
We may suspend or close an account that does these things. Where we can, we will tell you why first.
What you write and upload stays yours. You give us only the permission we need to store it and show it to the people you chose to show it to. We do not use your content to advertise, to train models, or for any purpose beyond running Saplet for you. You are responsible for having the right to upload anything you upload.
How we handle information is set out in the privacy policy, which forms part of these terms. The commitments there about journal privacy and about never selling data are promises, not preferences.
Saplet's software, design, name and logo belong to us. Using the app doesn't transfer any of that to you. You may not copy or reuse it beyond using the service normally.
We try to keep Saplet running and will give notice of planned downtime where we can. We can't promise it will never be unavailable, and we may change or discontinue features. If we ever shut Saplet down entirely, we will give you at least 30 days' notice and a way to export your data first.
Saplet is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that Saplet will be uninterrupted, error-free, or that it will produce any particular result in your household.
Please read this one properly. Saplet includes a feature that may offer a person a gentle prompt to reach out for support. It is a simple word check running on a phone. It is not monitoring, not supervision, not detection, and it is not capable of recognising most signs that someone is struggling. It will miss things.
Saplet is not a mental health service, a crisis service, a medical device, or a substitute for the care and attention of the people around a child. Do not rely on it to tell you that someone in your household needs help. Nothing in Saplet is medical, psychological, educational or legal advice.
If someone is in immediate danger, contact your local emergency services. If someone needs support, contact a qualified professional or a crisis line in your country.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost opportunities, arising from your use of Saplet. Our total liability for any claim relating to Saplet is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
If someone brings a claim against us because of how you used Saplet, or because of something you uploaded, you agree to cover our reasonable costs in dealing with it.
You can delete your household at any time from Settings, which ends this agreement. We may suspend or end your access if you break these terms, if we are legally required to, or if we discontinue the service. Sections that by their nature should survive, such as 11 to 14, survive.
We may update these terms. If a change matters, we will tell you in the app and by email before it takes effect. Continuing to use Saplet afterwards means you accept the new version.
These terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Colorado, and we each agree to that jurisdiction. If you are a consumer somewhere with laws that give you the right to bring a claim locally, this does not take that right away.
